Terms of Service

These terms cover your use of MISE AN PLACE as a business running a shop on it. Your own customers never see this page: the terms they read belong to your shop and live on your own web address.

This page describes how the service actually works, in words a person can read. It is not a substitute for advice from a lawyer, and it does not change any signed agreement.

1. What the service is

MISE AN PLACE gives a food business a storefront its customers can order from, and a dashboard for running the orders that come in: production lists, delivery, customers, and the daily cutoff that closes ordering for the next run.

We host the software. We do not make, handle, or deliver any food, and we are not a party to the sales you make. What you sell, what you charge, what you claim about allergens and ingredients, and whether you deliver it on time are yours.

2. Your account and your team

The account that creates a shop is its owner and cannot be moved out of that role, so a shop can never lose access to its own billing and payouts. Owners can invite managers and employees and change their roles at any time.

You are responsible for who you invite and for what they do with the access you give them. Tell us promptly if you think an account has been used by someone who should not have it.

3. What it costs

A new shop starts with a free trial. After that the subscription is a flat monthly fee for the plan you choose, billed in advance, and it renews each month until you cancel.

We take no percentage of your sales and charge no fee on your transactions. Money from your customers goes to your own payment account. Your payment provider charges its own processing fees, which are between you and them.

If a subscription payment fails we will tell you and keep the shop running for a short grace period. If it stays unpaid the shop is paused: the storefront stops serving customers and the dashboard shows a billing screen. Nothing is deleted while a shop is paused, and paying reopens it.

4. Taking payments from your customers

Customer payments run through Stripe, under your own Stripe account. You accept Stripe's terms directly with them, they hold the funds, and they pay out to your bank on their schedule. Refunds, chargebacks and disputes are between you, your customer, and Stripe.

We never hold your customers' money, and we never store their card numbers.

5. Who owns what

Your recipes, prices, photographs, written copy, customer list and order history remain yours. You give us only the permission needed to host and display them, which ends when you leave.

The software, its design, and the research behind its defaults remain ours. You may not copy or resell the platform itself.

6. Fair use

Do not use the service to:

  • break the law, including food safety and labelling rules
  • sell something you are not permitted to sell
  • send email to people who never asked to hear from you
  • attack or overload the platform, or try to reach another shop's data

We can suspend a shop that is doing any of these. If it is not urgent, we will tell you what is wrong first and give you a chance to fix it.

7. Leaving

You can cancel at any time from the dashboard. Cancelling stops the next renewal and keeps the shop running to the end of the period you have already paid for. We do not refund part-months unless the law where you are says otherwise.

You can export your catalog, customers and orders while your account is open. Do that before you cancel. After the account closes we keep your data for a limited period in case you come back, then delete it.

8. Uptime, and what happens when we get it wrong

We work to keep the service running and we tell you plainly when it breaks. We cannot promise it will never be unavailable. Nothing here is a guaranteed level of service unless we have signed one with you separately.

We are not liable for lost profit or lost sales. Where liability cannot be excluded, it is limited to what you paid us in the twelve months before the problem.

9. Changes

If we change these terms in a way that materially affects you, we will tell you in the dashboard or by email before it takes effect. Continuing to use the service after that means you accept the change. If you do not, you can cancel.
